GASAA help employers to prepare for Freedom of Choice Super

GASAA will be providing regular updates in the lead up to freedom of choice legislation that will come into play, from 1 July this year. Employees will be able to nominate a complying superannuation fund to receive their compulsory employer contribution.

Previously, employees covered by awards could only choose between award recognised super funds. The Graphic Arts Award has Printsuper and the Australian Retirement Fund as the only nominated funds. Leading up to 1 July 2005, employers will need to consult with all staff to obtain instructions as to where superannuation payments are to be made. Only when an employee does not elect to nominate a fund, will an employer be able to make the payment into the “default” award fund.

There are three ways in which decisions can be taken, as to how superannuation is to be directed. Firstly, the employee can initiate instructions by nominating in writing a complying fund (there are circumstances, when an employer can reject the fund elected by the employee). Secondly, the employer must give a standard choice form to all employees (unless an employee has already initiated a choice).

GASAA will assist members by issuing a draft standard form to present to employees. Finally, if an employee does not nominate a fund by the required date, the employer can nominate an alternate and complying fund. To download the "Standard Choice Form" click here
